Terms of Service

Agent Assist is a software platform that helps licensed Georgia real estate agents respond to leads, maintain a CRM, manage transactions, and run post-closing outreach, assisted by an AI assistant (“Maya”).

Agent Assist is not a real estate brokerage and does not provide real estate brokerage, legal, tax, lending, or financial advice. Information the platform or Maya provides is educational only. You remain solely responsible for your professional conduct and for compliance with all laws and the rules of the Georgia Real Estate Commission and your supervising broker.

• You must be a licensed real estate professional (or acting under the supervision of one) and at least 18 years old to use the service.
• You are responsible for the accuracy of your account information and for keeping your login credentials secure.
• You are responsible for all activity under your account, including messages Maya sends on your behalf after you configure or approve them.

Maya can draft and, where you enable it, send communications (email and SMS) to your leads and clients on your behalf, as your representative under your supervising Georgia broker. You acknowledge and agree that:

• Messages Maya sends are attributed to you and are your responsibility, exactly as if you had sent them yourself.
• You control Maya's automation settings, quiet hours, and approval requirements, and you are responsible for reviewing what goes out under your name.
• AI-generated content can contain errors. You are responsible for verifying facts, figures, and any statement that could be construed as legal, lending, or real estate advice before relying on or forwarding it.
• You will not use Maya to send unlawful, misleading, discriminatory, or harassing messages, or to violate Fair Housing, TCPA, CAN-SPAM, or Georgia advertising rules.

The service sends and receives text messages through your provisioned phone number. Message and data rates may apply. Message frequency varies based on your leads’ activity and your settings. Recipients can reply STOP to opt out and HELP for help; opt-outs are honored automatically. You are responsible for ensuring you have a lawful basis to message each recipient. See the Privacy Policy for how messaging data is handled.

• Paid plans are billed on a recurring monthly basis through our payment processor (Stripe). Current pricing is shown at signup.
• Fees are charged in advance and are non-refundable except where required by law.
• You can cancel at any time; cancellation stops future billing and takes effect at the end of the current billing period.
• Plans include monthly AI usage allowances. If you approach or exceed your plan's allowance, the platform will notify you and may limit further AI usage until the next cycle or an upgrade.
• We may change pricing with reasonable advance notice; changes apply to the next billing cycle.

You agree not to:

• Use the service for any unlawful purpose or in violation of real estate licensing, Fair Housing, advertising, or telemarketing/messaging laws.
• Upload or process data you do not have the right to use, or send messages to people who have not consented or with whom you have no lawful basis to communicate.
• Attempt to access another customer's account or data, probe or bypass security, or interfere with the service.
• Resell, sublicense, or misrepresent the service, or use it to build a competing product.

You retain ownership of the data you and your contacts submit (your contacts, leads, deals, and messages). You grant Agent Assist a limited license to process that data to provide and improve the service as described in the Privacy Policy. We do not sell your data.

The platform, software, and Maya (excluding your data) are owned by Agent Assist and its licensors and are protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.

The service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. Agent Assist does not warrant that AI output is accurate, complete, or suitable for any particular purpose, and is not responsible for actions you take based on it. Nothing in the service is legal, tax, lending, or real estate advice.

To the fullest extent permitted by law, Agent Assist will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim.

You may stop using the service and cancel at any time. We may suspend or terminate access for violation of these Terms or for non-payment. On termination, you may export your data for a reasonable period, after which it may be deleted in accordance with the Privacy Policy.

We may update these Terms from time to time. If we make material changes, we will provide notice. Continued use after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict-of-laws rules.
